Terms of Service

Benito is a personal AI concierge that autonomously executes real-world tasks on behalf of users — such as hiring services, making purchases, booking appointments, and managing errands. The Service operates through a conversational interface (web app, mobile app, and WhatsApp) and uses AI-driven planning to coordinate with third-party providers on your behalf.

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. By using Benito, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

• You are responsible for maintaining the security of your account credentials and phone number associated with the Service.
• You are responsible for all activity that occurs under your account, including all actions taken by the Service on your behalf.
• We reserve the right to suspend or terminate access if we suspect misuse, fraud, or violation of these Terms.

You agree not to use Benito to:

• Violate any applicable laws or regulations
• Harass, abuse, threaten, or harm any person or entity
• Send spam, unsolicited messages, or fraudulent communications
• Impersonate any person or entity, or misrepresent your identity or affiliation when the Service communicates with third parties on your behalf
• Direct the Service to contact individuals or businesses for purposes they have not consented to, or in a manner that constitutes harassment
• Make fraudulent commitments, bookings, or purchases through the Service
• Attempt to circumvent or manipulate the Service's approval mechanisms designed to require your confirmation before significant actions
• Attempt to gain unauthorized access to our systems or other users' data
• Use the Service for any illegal, deceptive, or malicious purpose
• Interfere with or disrupt the operation of the Service

Benito is designed to act as your agent, performing tasks in the real world under your direction. This includes contacting third-party providers, sending messages, making phone calls, browsing websites, making bookings, and initiating purchases on your behalf. By using the Service, you acknowledge and agree that:

• You are the principal. All actions taken by Benito on your behalf are performed under your authorization. You are responsible for the instructions you give and the actions that result from them.
• Authorization to act. You authorize Benito to communicate with third parties (businesses, service providers, individuals) on your behalf, using your name and contact information as necessary to complete the tasks you request.
• Approval for significant actions. The Service will request your explicit approval before taking actions that involve financial commitments or other irreversible consequences. You are responsible for reviewing and responding to approval requests carefully.
• Accuracy of information. You are responsible for providing accurate and complete information for the tasks you request. We are not liable for outcomes resulting from inaccurate or incomplete information you provide.
• Third-party relationships. Any agreements, bookings, purchases, or commitments made by the Service on your behalf create a relationship between you and the third-party provider — not between us and the third party. We are a facilitator, not a party to those transactions.

• Benito uses artificial intelligence to plan and execute tasks. While we strive for accuracy and reliability, AI-generated outputs may contain errors, inaccuracies, or misinterpretations.
• The Service may interact with third-party providers (businesses, service professionals, etc.) on your behalf. We do not guarantee the quality, availability, pricing, or reliability of third-party services.
• For actions that involve financial commitments or irreversible decisions, the system will request your explicit approval before proceeding.
• You acknowledge that AI-assisted task execution has inherent limitations and you should review important outcomes before relying on them.
• Benito does not provide professional advice. The Service is not a substitute for professional legal, medical, financial, tax, or other specialized advice. Any information or recommendations provided by the Service are for general assistance only and should not be relied upon as professional counsel.

The Service may communicate with you and with third parties via WhatsApp, email, phone calls, and other messaging platforms. Your use of these platforms is also subject to their own terms of service and privacy policies (e.g., WhatsApp Terms of Service, Meta Privacy Policy).

We use the WhatsApp Business Platform in compliance with Meta's policies. We are not responsible for WhatsApp's availability, performance, or data processing practices.

All content, software, branding, and technology comprising the Service are owned by Daver L.L.C-FZ or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent. You retain ownership of the content and data you provide to us.

Certain features of Benito may require payment. Applicable fees will be clearly communicated before you incur any charges. We reserve the right to modify pricing with reasonable advance notice. Any payments made for completed tasks are non-refundable unless otherwise required by law. Fees charged by third-party providers for services booked through Benito are separate from our fees and are governed by your agreement with that provider.

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular result will be achieved. We do not warrant the accuracy, completeness, or reliability of any action taken by the Service on your behalf or any output generated by the AI.

To the maximum extent permitted by applicable law, Daver L.L.C-FZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Without limiting the foregoing, we are not liable for:

• Actions taken by the Service on your behalf, including communications with or commitments made to third parties
• The quality, safety, legality, or outcome of any third-party service booked or arranged through the Service
• Errors, inaccuracies, or unintended consequences resulting from AI-generated decisions or actions
• Losses arising from your reliance on the Service's outputs as professional, legal, medical, or financial advice
• Service interruptions, downtime, or data loss

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Daver L.L.C-FZ, its officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) actions taken by the Service on your behalf, including any claims by third parties who were contacted, booked, or transacted with through the Service under your direction; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights.

You may stop using the Service at any time. We may suspend or terminate your access at our discretion, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. For material changes, we will notify you through the Service or by other reasonable means. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daver L.L.C-FZ regarding your use of the Service, and supersede any prior agreements or understandings.
